10. Copyright Policy and DMCA Notices
A. Respect for Copyright
FlagsOnly respects the intellectual property rights of others and expects users of the Site to do the same. FlagsOnly complies with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"), and will respond to properly submitted notices of claimed copyright infringement relating to material stored on or made available through the Site, including user-submitted player profiles, photographs, biographical content, links, and other user-generated content.
B. Designated Copyright Agent
FlagsOnly has designated the following agent to receive notifications of claimed copyright infringement: Copyright Agent FlagsOnly hello@flagsonly.com. Notices sent to any other address or contact may not receive a response.
C. Submitting a Notice of Claimed Infringement (Takedown Notice)
If you are a copyright owner, or authorized to act on behalf of one, and you believe that material on the Site infringes your copyright, you may submit a written notice to the Copyright Agent listed above. To be effective under 17 U.S.C. § 512(c)(3), your notice must include substantially all of the following: A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notice, a representative list of such works. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit FlagsOnly to locate the material. Please include the full URL of the page and, where applicable, a description of the specific photograph, text, video, or other element at issue. Information reasonably sufficient to permit FlagsOnly to contact you, including your name, mailing address, telephone number, and email address. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Incomplete notices may not be actionable. FlagsOnly may, at its discretion, request additional information before acting.
4. What Happens After a Notice
Upon receipt of a compliant notice, FlagsOnly will act expeditiously to remove or disable access to the material claimed to be infringing. FlagsOnly will make a reasonable effort to notify the user who submitted or is associated with the material that the material has been removed or disabled, and will provide that user with a copy of the takedown notice, which may include your contact information. FlagsOnly reserves the right to remove or disable access to any material at any time, with or without notice, for any reason or no reason, including content it believes in good faith may be infringing.
5. Counter-Notification
If you believe that material you submitted was removed or disabled by mistake or misidentification, you may submit a written counter-notification to the Copyright Agent listed above. To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must include substantially all of the following: Your physical or electronic signature. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled. Your name, address, and telephone number. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside of the United States, for any judicial district in which FlagsOnly may be found, and that you will accept service of process from the person who provided the original notice of claimed infringement or an agent of that person. Upon receipt of a compliant counter-notification, FlagsOnly will promptly provide a copy to the person who submitted the original takedown notice and will inform that person that the removed material may be replaced, or access to it restored, in approximately ten (10) or more business days. Unless the original complaining party notifies FlagsOnly that it has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material, FlagsOnly may replace the removed material or restore access to it in approximately ten (10) or more business days following receipt of the counter-notification.
6. Repeat Infringers
FlagsOnly will consider reasonable efforts to terminate, in appropriate circumstances and at its sole discretion, the accounts of, and access to the Site by, users who are deemed to be repeat infringers. FlagsOnly may also, at its sole discretion, limit access to the Site, remove content, or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
7. Misrepresentations
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred by FlagsOnly, by the alleged infringer, or by any copyright owner or copyright owner's licensee who is injured as a result of FlagsOnly relying upon such misrepresentation. Please consider carefully before submitting a notice or counter-notification.
8. Content Submitted by Users
Certain areas of the Site, including the FlagsOnly Player Index and its associated submission, photo, and change-request forms, allow users to submit content. By submitting content to the Site, you represent and warrant that you own the content or have all necessary rights, licenses, and permissions to submit it, and that its use by FlagsOnly as contemplated by these Terms will not infringe the rights of any third party. You grant FlagsOnly a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content in connection with operating and promoting the Site. Player Index entries are compiled from publicly available sources. If you are a player, program, federation, or rights holder and believe information or imagery associated with you or your organization should be corrected or removed, you may contact hello@flagsonly.com or use the request-a-change form on the Site. Claims of copyright infringement should be submitted through the DMCA procedure described above.
